Dear Stu,
There is nothing legal or illegal about this script. Its the way you make use of the script that could make your site either a legitimate affiliate business or simply a pyramid scheme.
If you sell legitimate products (ebooks, softwares etc) on your website and offer an incentive for existing members to refer new members, I don't think the business model is illegal in any way. Thats how all affiliate programs work.
But again I am not an attorney and I cannot provide you with any legal advice. Its best to contact a lawyer in your area and discuss with them your business model vis-a-vis your state laws.
